PROTECTION OF AVANTIQ'S RIGHTS AND THOSE OF THEIR LICENSORS
IQS Avantiq AG is a company registered in Switzerland. The name "Avantiq" is used as company name worldwide and protected as a registered trademark.
The Intellectual Property rights in the Avantiq databases and in all other data compilations, documents and other derivatives provided by Avantiq either belong to Avantiq or its partners and licensors.
Avantiq expects all partners in contract, companies or persons using the Avantiq service, either directly or indirectly, to respect the intellectual property rights of Avantiq and its partners, and to present Avantiq and its licensors on all documents (no matter what form – be it on paper or electronically) according to their instructions so that the ownership of the respective rights – concerning the databases and data made available as well as the execution of searches and distribution of data - are always clearly discernable. Copyright notations or other specifications relating to existing rights of third parties or those of Avantiq may not in any case be removed or modified.
All information and search reports provided by Avantiq are for the exclusive use of the designated Avantiq partners in contract, companies or persons using the Avantiq service. Such data may only be copied in as far as necessary in the normal course of business. Except otherwise provided in a contract with Avantiq no database may be compiled from the data received from the results of Avantiq’s offline and online searches conducted through Avantiq and in the Avantiq databases.
Avantiq undertakes to make every effort to respect the deadline for communication of the results of the searches. Nonetheless, Avantiq accepts no responsibility in the event of any failure to communicate or illegible or incomplete communication due to postal, telecommunications or technological services or delivery companies entrusted with the delivery of the search results.
Avantiq online databases are compiled with the utmost precision and are generally accurate and comprehensive. However, the information is taken from official records which are compiled and input by third parties. Avantiq accepts no liability for the information contained therein.
Each search is handled with the greatest care. However, we cannot guarantee the completeness and accuracy of the search reports, which are subject to a number of uncertainties of a legal, technical and personal nature. The presentation of the Online and Offline search results are based on certain technical preconditions and/or personal experience. The kind of presentation is, however, of no legal relevance and requires the clients own judgment. We must therefore deny all liability for the results of the searches.
The local opinions provided in the availability searches by our associates are based on the experience and knowledge of the local authors, but are of a largely subjective character and can only give an estimation on the legal situation and its current and future relevance for the trademarks to be searched. The Opinion cannot replace the client’s own judgment. We must therefore deny all liability for the results of the searches and the respective Opinions. Please also refer to our associates general conditions and Disclaimers as far as provided.
Avantiq accepts no responsibility for delays or errors caused by force majeure, including but not limited to acts of public authorities, storms, political unrest, social disorder, computer or technological breakdowns or failures and or any negligent acts of third parties.
PAYMENTS
Payments are due after receipt of the invoice. They are to be settled within 30 days of receipt of the invoice at the latest, unless prior arrangements have been made with Avantiq. A late charge of 1.25 % per month will be automatically applied for all late payments. The official currency of Avantiq is the Euro; payments in other currencies are possible upon request.
GOVERNING LAW AND JURISDICTIONS
The general conditions and all contracts or orders, to whom they are applicable, shall be interpreted and construed according to, and governed by the laws of Switzerland. The courts of Zurich shall have exclusive jurisdiction.

Avantiq provides trademark, domain name and company name search services only. Avantiq does not provide legal consultation or legal opinions. Legal opinions as part of full availability searches are provided exclusively by local attorneys and are forwarded by Avantiq to the clients.
